What It Means
Under RCW 4.20.010, the personal representative may sue the person who caused the death for the economic and noneconomic damages sustained by the family members the law lists, in amounts the judge or jury finds just.
RCW 4.20.020 names those family members:
- The spouse or state registered domestic partner, and the children, including stepchildren.
- If there is no spouse, domestic partner, or child, the deceased person’s parents or siblings.
Washington also has survival laws. Under RCW 4.20.046 and 4.20.060, certain claims the person could have brought do not end with their death. The personal representative may recover the deceased person’s own economic losses, and damages for the pain and suffering, anxiety, emotional distress, or humiliation they experienced, for the benefit of the same family members.
The filing deadline for a wrongful death claim, and when it starts, can depend on the facts, so please confirm it with a lawyer as early as you are able.
Why It Matters in a Truck Accident Case
When a truck or bus crash takes a life, the family faces both grief and a complicated legal process. A claim may require naming the right personal representative, identifying the beneficiaries, measuring the financial and personal losses, and finding every party responsible for the crash. Evidence held by the trucking company can disappear quickly, so acting early helps protect the family’s options.
